Terms of Service

These Terms of Service ("Terms") govern access to and use of the software platform operated by DetencionDefensa.com, Inc. (d/b/a SaveMyHomeTrust.io, the "Company"). By accessing or using the Services you agree to these Terms.

1. Not a law firm; no legal advice

The Company is a Delaware corporation and is not a law firm. The Services are a document-assembly and workflow tool. The Company does not provide legal advice and does not form an attorney-client relationship with any user. Substantive legal review is performed by Sorrentino Law Firm, PLLC, a separate Florida-licensed law firm, and by the client's own attorney of record.

2. Eligibility

Attorney accounts must be held by attorneys in good standing with a U.S. state bar. Reviewer, vendor, and brokerage accounts require the applicable professional license. Client accounts are opened by an attorney of record.

3. Fees

Software fees, reviewer flat fees, and verified data-lead fees are described in the applicable engagement letter, order form, or in-product disclosure. Vendor fees flow directly to the vendor and are not shared with the Company. Legal fees are set by and paid directly to the client's attorney; the Company does not share in attorney fees (Florida Bar Rule 4-5.4).

4. No lending or funding guarantee

The Company does not lend money and does not guarantee approval, timing, or terms of any HELOC, Non-QM, bridge, or other financing arranged through the platform. Financing is provided by independent third-party lenders subject to their underwriting.

5. Acceptable use

You will not misuse the Services, upload unlawful content, attempt to gain unauthorized access, interfere with the platform, or use it in a way that violates the Florida Bar Rules or applicable law.

6. Intellectual property

The Company retains all rights in the platform, its models, templates, and software. You retain rights in your own content and grant the Company a license to process it as needed to deliver the Services.

7. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. The Company's aggregate liability for any claim arising out of the Services is limited to the fees you paid to the Company in the twelve (12) months preceding the claim.

9. Indemnification

You will indemnify and hold harmless the Company from any claim arising out of your misuse of the Services or violation of these Terms.

10. Termination

Either party may terminate a user account at any time. Provisions that by their nature should survive termination will survive.

11. Governing law; dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida, and the parties consent to personal jurisdiction there.

12. Changes

The Company may update these Terms by posting a revised version and updating the effective date. Material changes will be notified by email.
